November 1, 2018 Girones Lawyers have recently resolved a significant birth injury lawsuit. This award will help our client’s child, a young boy with quadriplegia and cerebral palsy, pay for the equipment, therapies and 24 hour attendant care he will need for the rest of his life.
Our client was a full-term mom who had an uneventful and healthy pregnancy. She attended at the hospital in early labour and the obstetrician on duty choose to “hurry’ along the labour. The doctor choose to artificially rupture the membranes ( break the waters) when it was unsafe to do so.
At the time of mother’s arrival, the baby’s head was floating outside of the mother’s pelvis (an unengaged head). A prudent doctor should almost never break the waters when the head is floating. In this case, when the waters were broken and the fluid rushed out, so did the baby’s umbilical cord. The cord was now below the baby’s head, hanging outside of the mother’s birth canal
This is called a cord prolapse and is an obstetrical emergency. The baby’s flow of blood and oxygen was interrupted and as a result, the baby was deprived of oxygen, and the heart rate dropped dangerously low. An emergency caesarian section was called but by the time the baby was delivered, he had been without sufficient oxygen for over 30 minutes.
The baby was born blue and with a low heart beat. He experienced seizures and had to be transferred to a specialized infant hospital unit. His brain imaging revealed swelling and eventually permanent brain damage. This child will never walk or talk on his own and will need assistance with every activity of daily living, for the rest of his life.
All funds needed to process this claim were paid for by Girones Lawyers and all infant settlements are approved by the Ontario Superior Court of Justice.
