Whether you own a private home or a business open to the public, you are responsible for maintaining your property in such a way as to make it reasonably safe for others. If someone slips or trips and falls on your property, you may be held financially responsible for their injuries.
If you own a rental property and you are responsible for maintenance and repairs, you may be held liable if your tenant is injured in a fall on your property.
Many slip or trip and fall accidents are preventable. There are a few steps that you can take to ensure that you keep your home or business safe for others.
- Snow and ice should be removed as soon as they begin to accumulate. Ensure that all parking lots, driveways, walking paths, steps and entrances are clear of snow. Don’t forget about emergency exits that may not be used regularly. The use of sand or salt can reduce ice from walking surfaces. If you will not be available to perform snow removal duties yourself, consider hiring someone. If leaks or floods from your property are causing the accumulation of ice, consider whether you can perform any repairs to permanently fix the problem.
- Keep floors and walkways free of hazards. Remove debris and loose items from floors and outdoor surfaces. Clearly label any hazards that cannot be cleared away, such as construction or renovation materials. Make sure that electrical cords and cables are taped down or covered so they don’t trip anyone.
- Keep indoor surfaces dry. Make sure that you clean up any liquid that is spilled or accumulated on the flooring, creating a slippery spot. In the winter, everyone who enters your home or business may be tracking in snow or water. Consider asking visitors to remove footwear, or install mats to soak up the excess liquid.
- Repair uneven flooring surfaces and railings. Loose tiles, carpeting and broken walkways can all create tripping hazards. Loose or broken railings or stair treads can also cause accidents.
- Ensure that lighting is adequate to prevent falls. As a property owner, you may be held responsible if inadequate lighting causes someone to trip and fall. Stairwells and outdoor obstacles such as pools or gardens should be given careful consideration.
As a home or business owner, making a regular survey of your property for hazards can be the best way of preventing this type of accident from occurring. If you have been injured in a slip and fall accident, contact a lawyer as soon as possible.
