Who can sue for a dog attack?

The answer in Ontario is almost anyone. According to the “Dog Owners Liability Act” a dog owner is strictly liable for any damages their dog causes and no legal defences are available. The owner of a dog that bites or attacks a person or another pet will be presumed liable for the damages caused by the dog. A dog does not have to bite in order to injure someone. A larger dog may cause serious injury to a person by jumping on them or otherwise knocking them over.

In addition to ordering a dog owner to compensate the injured victim, Ontario courts have the ability to make particular orders to protect public safety. This may include removing a dog from its owner’s care, having a dog destroyed, requiring that the owner keep a dog muzzled and leashed in public and even prohibiting an owner from having any dogs for a particular period of time. What’s more, if the dog owner owns a home, the home insurance policy may apply and cover attack-related damages. Limitations and rules of course apply, but any severe dog attack certainly should be investigated by a law firm.
